Valid and binding contractual terms for accommodation at the Casa Žabka resort. This English translation is provided for convenience only – the Slovak version is legally binding.
These general terms and conditions (hereinafter also "GTC"), which include the Accommodation Rules and the Complaints Rules, form a binding and integral part of the contract concluded between the Landlord and the Customer. If the Customer and the Landlord conclude a contract with terms differing from the GTC, the specific provisions of that contract always take precedence over the GTC. By ticking the relevant checkbox during the contract conclusion process on the web portal and by sending the reservation, the Customer confirms that they have read these GTC, fully understood their content and all conditions, agree with them, and are aware that the GTC form an integral part of the contract concluded between them and the Landlord.
These terms and conditions govern the rights and obligations of the Landlord, whose identification details are as follows:

The Landlord provides accommodation services to the guest via the online reservation system. The contract between the Landlord and the Customer is formed under the conditions set out in Article 5(2) of these GTC, notwithstanding the fact that the Customer makes the online reservation via the reservation system.
For the purposes of these GTC, the Customer means any natural or legal person who uses the online reservation system or concludes an accommodation contract.
These terms and conditions apply to the accommodation contract, the use of the online reservation system, payment and cancellation conditions, and all other rights and obligations arising from the legal relationship created by the reservation.
By sending an online reservation to the Landlord via the Landlord's website, the Customer agrees that these terms and conditions shall govern the accommodation contract concluded between the Customer and the Landlord, as well as any relationship arising from or in connection with the conclusion of the accommodation contract or with complaints about the accommodation services provided by the Landlord.
These terms and conditions form an integral part of the accommodation contract. If the Landlord and the Customer agree in writing on conditions other than those set out in these terms and conditions, the provisions of such written agreement take precedence over these terms and conditions.
The Landlord and the Customer have agreed that if the contractual relationship established between them by concluding the accommodation contract, or arising in connection with its conclusion, contains a foreign element (e.g. the Customer is a citizen of a state other than the Slovak Republic), such relationship shall be governed by the law of the Slovak Republic.
The Accommodation Rules and the Complaints Rules, both published on this website, form an integral part of these GTC.
The Customer may use online reservations only if they agree to these terms and conditions. The Customer is required to read these terms and conditions before completing the reservation. By confirming the reservation, the Customer expresses their unconditional agreement to these terms and conditions.
By using the online reservation system, a Customer who is a natural person declares that they are at least 18 years of age and have the capacity to acquire rights and assume obligations in their own name.
An online reservation sent to the Landlord constitutes a proposal to conclude an accommodation contract under the contractual conditions set out in these terms and conditions.
An online reservation is made via the reservation form; completing it in full according to the Landlord's instructions is a precondition for creating a binding reservation.
The Landlord may confirm receipt of the reservation to the guest immediately after it is delivered to the Landlord. Such confirmation of receipt does not constitute binding acceptance of the reservation and is not considered conclusion of the contract. The confirmation is for information only, to confirm that the Landlord has received the reservation form; it will contain the Customer's identification details, the designation of the accommodation unit, the number of nights and persons, arrival and departure, the accommodation price and the chosen payment method.
The Landlord bindingly accepts the Customer's reservation by sending an e-mail to the Customer's e-mail address after proper and timely payment of the accommodation price under these GTC; this message will be marked "Reservation Confirmation". At that moment, i.e. upon sending the "Reservation Confirmation", the accommodation contract is concluded. The body of the message will state the identification details of the Landlord and the Customer, the designation of the accommodation unit, the number of nights and persons, arrival and departure, the accommodation price and the chosen payment method. An invoice will be attached to this e-mail. Any further information related to the reservation will be sent to the Customer's e-mail address as needed. The Landlord advises the Customer that the accommodation is reserved only upon this Reservation Confirmation, i.e. only after payment of the accommodation price. The details required for issuing the invoice are:
The Customer has the right to cancel a reservation via the official e-mail address. The cancellation takes effect towards the Landlord on the day the cancellation notice is delivered.
The cancellation fee means the agreed contractual penalty charged to the guest if the Customer cancels the reservation or fails to arrive for the stay, even without prior cancellation of the reservation.
If a reservation is cancelled, the cancellation fee is charged as follows:
The Landlord is entitled to charge a cancellation fee of 100% of the accommodation price even if the Customer fails to arrive for the stay without cancelling the reservation. The Landlord may set off the cancellation fee against the accommodation price paid.
In the event of serious reasons for cancellation on the Customer's side, the cancellation fee may be reduced or waived upon notification and submission of credible evidence of the cause to the Landlord. However, there is no legal entitlement to a waiver or reduction of the fee.
The Landlord has the right to cancel the online reservation (withdraw from the contract) within 24 hours of delivery of the Reservation Confirmation due to overbooking, i.e. due to a delayed reservation of accommodation services from various booking portals. In such a case, the Landlord will notify the Customer of the cancellation of the online reservation (withdrawal from the contract) and refund the accommodation price paid. The Customer is not entitled to compensation for any damage that may arise in connection with the cancellation of the reservation (withdrawal from the contract), nor to any other compensation or fees.
All prices for accommodation services and all other fees stated in these terms and conditions are given in euros (EUR) and include VAT where VAT applies.
The Customer is required to pay the price for the accommodation services according to the order. Together with the accommodation price, the Customer must pay the fees to which the Landlord is entitled under the conditions set out in these terms and conditions. Accommodation prices are stated exclusive of the local tax, which the Customer pays on site at check-in in accordance with these GTC.
In the case of an online reservation, the Customer may pay the accommodation price to the Landlord in the following ways:
In accordance with the applicable local tax legislation of the country of accommodation, the Customer is required to pay the tourist tax at the currently applicable rate, and any other fees arising from generally binding legislation.
Other fees and payments for separately provided and ordered services may be paid by the Customer in the same way as accommodation payments, or on site as follows:
The rights and obligations set out in these GTC apply accordingly to the Customer as well as to accompanying persons.
The Landlord processes the personal data provided by the Customer, namely first name, surname, town/municipality, country, e-mail and telephone number, as processing of these personal data is necessary for the performance of the contract – provision of the ordered services – and/or for handling the Customer's pre-contractual requests related to the Landlord's services, and for the fulfilment of the Landlord's obligations under generally binding legislation. The Landlord processes personal data for the time necessary to exercise the rights and obligations arising from the contract and from generally binding legislation. Providing personal data to the Landlord is necessary to fulfil the above purposes; without them, it would not be possible to provide the Customer with the ordered services.
By ticking the relevant box before submitting the order, the Customer may consent to receiving information about the Landlord's news and special offers (newsletter). By ticking this box, the Customer, as a data subject, freely and voluntarily grants the Landlord, within the meaning of the GDPR, their express consent to the processing of the provided e-mail address for marketing purposes – sending the newsletter by e-mail. The Customer grants this consent to personal data processing for a period of 5 years.
The Customer is responsible for the completeness, truthfulness and accuracy of the personal data provided. If the provided personal data change, the Customer must notify the Landlord of the change without delay.
The Customer may withdraw their consent to the processing of personal data for marketing purposes (newsletter) at any time by clicking the relevant link included in every marketing e-mail from the Landlord or by sending an e-mail to the Landlord.
If the personal data provided become outdated, if consent to processing is withdrawn, once the purpose or period for which consent was granted has been fulfilled, or if storage is inadmissible for any legal reason, the stored personal data will be erased.
The Customer's rights as a data subject are governed by Articles 12–22 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC ("GDPR"). Subject to the requirements laid down in the GDPR, the Customer has (i) the right of access to their personal data, (ii) the right to rectification of inaccurate personal data, (iii) the right to restriction (blocking) of processing, (iv) the right to erasure of personal data, (v) the right to data portability, and (vi) the right to lodge a complaint with the supervisory authority – the Office for Personal Data Protection of the Slovak Republic, Hraničná 12, 820 07 Bratislava – if they suspect that their personal data are being processed contrary to applicable legislation.
If the Customer exercises any of their data subject rights under data protection legislation and the applicant's identity cannot be verified from the request, or if the Landlord has legitimate doubts about the identity of the person submitting the request, the Landlord reserves the right to ask that person for additional information necessary to confirm the identity of the person making the request.
The Customer's personal data may, to the extent necessary, also be provided to the following entities or categories of entities where necessary to fulfil the purpose for which they were obtained, in particular the owner of the accommodation unit, providers of the ordered services, the company handling marketing campaigns, the company ensuring the technical operation and administration of the web portal, and the web hosting provider. Data provided to third parties may be used solely for the purposes for which the personal data were obtained.
The Landlord reserves the right to amend these GTC. The obligation to give notice of an amendment to the GTC is deemed fulfilled by publishing it on the Landlord's web portal. However, a validly concluded contract is governed by the GTC valid at the time it was concluded.
The Customer may not assign their receivables against the Landlord arising from this contract to third parties without the Landlord's consent.
All contractual relationships between the Landlord and the Customer are governed by the law of the Slovak Republic.
The invalidity or unenforceability of any provision of the GTC shall not affect the validity or enforceability of any other provision of the GTC, provided such provision is severable from the remaining provisions of these GTC.
These GTC are effective from 1 July 2023.
